Terms & Conditions

Please read these terms and conditions carefully before using our Service.

1. INTERPRETATION AND DEFINITIONS

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Flygreen (referred to as either "Flygreen", "We", "Us" or "Our" in this Agreement) refers to Flygreen.
  • Service refers to the Website.
  • Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the company regarding the use of the Service.
  • Website refers to Flygreen, accessible from https://www.flygreen.co/
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3. TRAVEL REQUIREMENTS

As a traveler, You must know and understand the applicable legal requirements related to travel, including passport, visa and health requirements. The ultimate responsibility for obtaining this information and complying with any and all passport, visa, health or other requirements remains solely and exclusively with You.

Every destination has its own requirements concerning entry formalities, vaccinations, etc. and these may also vary depending on the nationality of the passenger. We recommend that You obtain this information before planning Your journey. Flygreen cannot be responsible for incidents deriving from You being non-observant of these official requirements. Some jurisdictions require birth certificates for all minors traveling. The ultimate responsibility for obtaining this information and complying with any and all passport, visa, health or other requirements remains solely and exclusively with You.

BY OFFERING BOOKINGS FOR PARTICULAR INTERNATIONAL DESTINATIONS, FLYGREEN.CO DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH AREAS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

4. PRICE AND FOREIGN CURRENCY TRANSACTIONS

Pricing is displayed in USD and/or CAD currency.

We reserve the right to cancel a reservation that has been accepted if full payment is not received in a timely fashion

If the currency that was shown to You on our site at the time of booking is different than the currency associated with Your form of payment, the bank or financial institution that issued Your credit card may charge a fee for international and/or foreign currency transactions.

Your bank or credit card company determines the currency exchange rate and the amount of the foreign transaction fee on the day it processes the transaction. Please contact Your bank or credit card company should You have any questions about these fees or the exchange rate applied to Your transaction.

In addition, a foreign transaction fee may be assessed if the bank that issued Your credit card is located outside Canada.

5. WARRANTIES AND DISCLAIMERS

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the company, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the company provides no warranty or undertaking, and makes no representation of any kind that the service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the company nor any of the company’s provider makes any representation or warranty of any kind, expressed or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the service; or (iv) that the service, its servers, the content, or e-mails sent from or on behalf of the company are free of viruses, scripts, trojan horses, worms, malware, or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, LOSS OF PRIVACY ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE, THIRD-PARTY SOFTWARE AND/OR THIRD-PARTY HARDWARE USED WITH THE SERVICE, OR OTHERWISE IN CONNECTION WITH ANY PROVISION OF THIS TERMS), EVEN IF THE COMPANY OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF THE REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

6. INTELLECTUAL PROPERTY

Our Website, including its underlying software and its text, design, graphics, layout and content, is owned or licensed by us or by the respective owners. All material on our Website is protected by Canadian and international intellectual property laws.

As a visitor to or user of our Website, You have permission to view, use and electronically copy the pages and content of our Website through the usual and ordinary use of a web browser.

Any other use of our Website and its contents, such as copying, distributing, selling, modifying, transmitting, reusing, re-posting or publishing, is not permitted and is strictly prohibited without the specific written permission of the owner(s) of such material.

Any unauthorized use of our Website or its contents will breach this agreement and may void Your permission to use our Website. It may also violate copyright and other laws.

Certain trademarks, service marks, business names, company names and logos used on our Website are owned by us or by our licensors. In particular, we own the trademarks “Flygreen” and “Flygreen.co”, which is a registered trademark.

You do not have a right, license or permission to use any of the forgoing except as expressly set out in this Section.

7. INDEMNIFICATION

You agree to indemnify and defend Flygreen.co and/or its certified flight operators and any of their officers, directors, employees and agents from and against any and all losses, damages, claims, causes of action, demands, recoveries, fines, penalties, or other costs and expenses of any kind or nature including reasonable legal and accounting fees brought by a third parties as a result of:

  • Your breach of these Terms; or
  • Your violation of any law or the rights of a third party; or
  • Your use of our Website.

8. GOVERNING LAW

The laws of the Country, excluding its conflicts of law rules, shall govern these terms and Your use of the Service. Your use of the application may also be subject to other local, state, national, or international laws.

9. DISPUTES RESOLUTION

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the company.

Fly Green believes in protecting Your privacy. Please visit our current Privacy Policy (the “Privacy Policy”) which also governs Your use of our Website. It contains information about how Flygreen.co collects, uses, and discloses information through the Services.

11. TERMINATION

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms and conditions. Upon termination, your right to use the service will cease immediately.

13. GENERAL

If any of these Terms are found by a court or other legal authority to be invalid or unenforceable, the invalid or unenforceable provisions will be stricken. The remaining terms and conditions will remain in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
